PRIVACY POLICY

Safeguarding the privacy of your confidential information is of great importance to us. This Policy summarizes the privacy policies that we will apply to your usage of our Services and Sites and to your Registration Info and Content ("User Info"). Please refer to our Terms of Service for capitalized terms not expressly defined in this Privacy Policy.

Sources of User Info

The primary ways in which we collect User Info from you include the following:

  • Registration Info you provide when you create an account identity and log-in.
  • Cookies, a data element that a site provides to a visitor's browser and that may be stored on the user's computer.
  • Usage activity related to our Services and Sites, including searches, page navigation and publication and materialization of configurations.
  • Content that you upload, publish or distribute through our Sites and Services, including configuration metadata, forum postings, bug reports and help inquiries.
  • Links to external sites that are provided on our Sites.

Uses of User Info

In general, we use your User Info only for the following purposes:

  • Providing you with a more capable user experience by organizing your Content and usage activity around your user identity. For this purpose, your User Info is visible only to us for use in administering your account identity, with the exception of your selected log-in name, which will be visible to other users in some cases to denote the author of given Content.
  • Providing a more capable set of Services by drawing from the combined usage activity and Content of our user community. For this purpose, any association between your Content or usage information, or your other User Info, and your Registration Info will be invisible to users of Services, and also will be generally irrelevant to the scope of those Services.
  • Identifying new Services or enhancement to our Sites by observing the usage activity of our user community. For this purpose, other users will not have access to your User Info and, in most cases, any association between a specific user identity and a new or enhanced capability will be irrelevant to our analysis as well.
  • Improving the availability and reliability of our Sites and Servers. For this purpose, users will not have access to User Info and, as above, specific user identities will generally be irrelevant to our efforts.

In the case of your Registration Info, and any other identifying information that you provide to us, we will generally use that information only to communicate with you regarding your use of our Services and their availability or to inform you of new or discontinued Services; facilitate your access to our Services and Sites; to organize your Content and usage activity for efficient retrieval by you; and to allow other users to find Content authored under your log-in name. If we ever intend to use your Registration Info for an unrelated purpose, then we will ask for your consent prior to such use. If we ever propose to make your Registration Info available to other users, or to make explicit the association between your Registration Info and your Content or usage activity, then we will provide you with an effective mechanism of opting out of making your Registration Info so available.

Sharing of User Info

We share Registration Info, and other identifying information you may provide to us, with third parties without your express prior consent only when we believe in good faith that disclosure is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce our Terms, including investigation of potential violations, (c) detect, prevent, or otherwise address fraud or security breaches, or (d) protect against imminent harm to our intellectual property right or operations or those of other users. We may share aggregated information that does not identify a particular user with third parties from time to time.

We do not currently monetize user activity through advertising or facilitating solicitations of any kind by third parties, nor do we share User Info with business partners or other third parties. In each case, we also have no current plans to do so.

If we become involved in a merger, acquisition, or any form of sale of some or all of its assets, we will provide notice before personal information is transferred and becomes subject to a different privacy policy.

Information Security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict internal access to User Info personal information to employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Data integrity

We process User Info only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the User Info needed to provide or improve our services. We take reasonable measures to ensure that the User Info we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Accessing and Updating User Info

When you use our Services and Sites, we make good faith efforts to provide you with access to your User Info and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on archival media), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

Enforcement

In the event we learn that security of our Services and Sites has been compromised or User Info has been disclosed without permission, including but not limited to external security attacks, we will take reasonable measures to protect against similar compromises or disclosure in the future, including but not limited to internal investigation and cooperation with law enforcement authorities.

If we become aware that a user's Registration Info, or other identifying information, has been disclosed in an unauthorized manner, we will make reasonable efforts to notify the affected user, as soon as reasonably possible and as permitted by law, as to what information we know or suspect has been disclosed.

Changes to this policy

Please note that this Privacy Policy may change from time to time, although we expect that most such changes will be minor. Regardless, we make each superseded version of this Policy available on our website (see http://www.cloudsmith.com:80/INFO-privacy-archive.html), indicating the date on which a given version was superseded and the changes made compared to the previously effective version.

No Legal Obligation Intended

While this Privacy Policy is a statement of our standards and policies for protection of User Information, we are unable to guarantee that the standards always will be met due to the possibility of human error, failure to follow our own policies or factors beyond our control. We therefore make no representation or warranty to you regarding the protection of your User Information and will not be legally obligated to you in the event of disclosure in violation of this Policy. You should take this into consideration when deciding whether to use our Services and Sites.
